CITY OF GLENDALE -- COMMON COUNCIL

April 14, 2008

 

                    Regular meeting of the Common Council of the City of Glendale held in the Municipal Building, 5909 North Milwaukee River Parkway.

 

                    The meeting was called to order by Mayor Jerome A. Tepper at 7:00 p.m.

 

                    Roll Call:  Present:  Mayor Jerome A. Tepper, Ald. Robert Whitaker, Joseph V. Colacino, Elliott L. Moeser, Richard W. Wiese, Izzy Goldberg and JoAnn Shaw.  Absent:  None.

                    Other Officials Present:  Richard Maslowski, City Administrator; Tom Czarnyszka, Police Chief; and John Fuchs, City Attorney.

 

PLEDGE OF ALLEGIANCE.

 

                    The members of the Common Council, City staff and all those present pledged allegiance to the flag of the United States of America.

 

OPEN MEETING NOTICE.

 

                    The City Administrator advised that in accordance with the Open Meeting Law, the local news media was advised on Thursday, April 10, 2008, of the date of this meeting; that the agenda was posted on the official bulletin board of City Hall, the Glendale Police Department, and the North Shore Library; that copies of the agenda were made available to the general public in the Municipal Building and the Police Department, and those persons who requested, were sent copies of the agenda.

 

ADOPTION OF COUNCIL MINUTES.

 

                    Motion was made by Ald. Colacino, seconded by Ald. Whitaker, approving the minutes of the meeting held on March 24, 2008.  Ayes:  Ald. Whitaker, Colacino, Moeser, Wiese, Goldberg and Shaw.  Noes:  None.  Absent:  None.  Motion carried unanimously.

COMMUNICATIONS, APPLICATIONS AND PETITIONS:

                    Communication from Public Works Director Dave Eastman, re:  Concrete Proposal for 2008 Crestwood Subdivision Street Project.

 

                    LaLonde Contractors, Inc. has submitted a proposal in the amount of $142,132.00 to install concrete pavement in place of asphalt pavement for the reconstruction of North Bethmaur Lane, North Dexter Avenue, North Braeburn Lane and West Como Place.  The Public Works Director has reviewed the proposal and is recommending approval of concrete pavement for this project, inasmuch as concrete pavement has greater longevity and less future maintenance costs.

                    Based upon the recommendation of the Public Works Director, motion was made by Ald. Shaw, seconded by Ald. Wiese, to approve the proposal submitted by LaLonde Contractors, Inc. in the amount of $142,132.00 for concrete pavement in place of asphalt pavement for the reconstruction of North Bethmaur Lane, North Dexter Avenue, North Braeburn Lane and West Como Place.  On Roll Call:  Ayes:  Ald. Whitaker, Moeser, Wiese, Goldberg and Shaw.  Noes:  Ald. Colacino.  Absent:  None.  Motion carried five votes to one vote.

                    Application for Transient Merchant Permit filed by John Murphy (Fabian Seafood)-Renewal.

 

                    Motion was made by Ald. Shaw, seconded by Ald. Goldberg, to approve the Application for Transient Merchant Permit filed by John N. Murphy, d.b.a. Fabian Seafood Co. as submitted, the Council having found as a matter of fact, that the issuance of the permit would not cause traffic or noise problems and that adequate off-street parking was available.  Ayes:  Ald. Whitaker, Colacino, Wiese, Goldberg and Shaw.  Noes:  Ald. Moeser.  Absent:  None.  Motion carried five votes to one vote.

                    Status Report of Various City Pedestrian/Bicycle Safety Programs, including Bike Paths, North Green Bay Avenue, North Milwaukee River Parkway and West Good Hope Road.

 

                    The City Administrator gave a PowerPoint presentation, which detailed the status of various City efforts in increasing the number of pedestrian/sidewalk pathways and bicycle lanes throughout the City.  The locations, designs, costs and various financial grant applications are underway for numerous sites.  Specific projects are:  1) Bicycle path from North Sidney Place to West Mill Road; 2) Bicycle/pedestrian pathway on North Milwaukee River Parkway from West Bender Road south to North Sunny Point Road; 3) North Green Bay Avenue sidewalk extension and intersection redesign; 4) North Good Hope Road pedestrian pathway and access to Kletzsch Park; and 5) Future programs under consideration including Milwaukee County's desire to establish a bike path along railroad right-of-way; potential sidewalk extension along West Green Tree Road east of North Green Bay Avenue and east of I-43; West Civic Drive from North Green Bay Avenue to North Milwaukee River Parkway; and North Lydell Avenue north of West Silver Spring Drive.  Most of these specific projects, if properly funded, would take place within the next two years.

                    Motion was made by Ald. Goldberg, seconded by Ald. Wiese, to place this information on file.  Ayes:  Ald. Whitaker, Colacino, Moeser, Wiese, Goldberg and Shaw.  Noes:  None.  Absent:  None.  Motion carried unanimously.

                    Status Report on Federal Snow Assistance Funding.

 

                    As indicated at the last Council meeting, the Federal Emergency Management Agency (FEMA) approved Governor Doyle's request for emergency snow assistance for Milwaukee County for the snow storm that occurred on February 6 and 7, 2008.  City staff attended a FEMA briefing on April 2, 2008, in which a formal request on behalf of the City was completed for federal financial assistance.  FEMA would provide reimbursement to the City for 75% of the total eligible costs of equipment, contractors and personnel overtime related to the snow storm.  In addition to the FEMA funding, the State will provide an additional 12.5% funding.  Pending final FEMA review, it would appear the City may be reimbursed approximately $50,000 for its snow removal efforts for this snow storm.

                    Ald. Moeser thanked staff for providing the snow assistance information to the school districts and Cardinal Stritch University.

                    Motion was made by Ald. Whitaker, seconded by Ald. Colacino, to place this information on file.  Ayes:  Ald. Whitaker, Colacino, Moeser, Wiese, Goldberg and Shaw.  Noes:  None.  Absent:  None.  Motion carried unanimously.

                    Ordinance Amending Section 15-5-17,18 of the Code Pertaining to Property Maintenance Violations and Enforcement of Code Violations.

 

                    Prior to prosecution in Municipal Court of property maintenance matters, the current code requires notice to the responsible party.  The notice also provides the property owner are opportunity to correct the violation and thus avoid prosecution.  As drafted, the process is very cumbersome, in that three notices are required.  This amendment revision to the notice and enforcement provisions corrects the process.

                    Motion was made by Ald. Shaw, seconded by Ald. Whitaker, to adopt Ordinance No. 1435 Pertaining to Property Maintenance Violations and Enforcement of Code Violations.  On Roll Call:  Ayes:  Ald. Whitaker, Colacino, Moeser, Wiese, Goldberg and Shaw.  Noes:  None.  Absent:  None.  Motion carried unanimously.

                    Ordinance Amending Section 13-1-144 of the Code Pertaining to Dumpsters.

 

                    Recently a property owner in a single-family residential district attempted to take advantage of the exception which allows dumpsters at multi-family residences.  He was under the impression that the dumpster could be placed on pavement and screened, and could stay on the premises for more than thirty (30) days.  That exception to the Code applies to multi-unit developments.  This amendment corrects the verbiage of the Code.

                    Motion was made by Ald. Colacino, seconded by Ald. Wiese, to adopt Ordinance No. 1436 Pertaining to Dumpsters.  On Roll Call:  Ayes:  Ald. Whitaker, Colacino, Moeser, Wiese, Goldberg and Shaw.  Noes:  None.  Absent:  None.  Motion carried unanimously.

                    Certified Survey Map, 4287 North Port Washington Road.

 

                    Based upon the recommendation of the Plan Commission, motion was made by Ald. Colacino, seconded by Ald. Whitaker, to approve the Certified Survey Map of Maglio Family, L.L.C., 4287 North Port Washington Road, subject to payment of the $75.00 administrative fee, making any required technical corrections, and payment of City Engineer CSM technical review fees, if any.  On Roll Call:  Ayes:  Ald. Whitaker, Colacino, Moeser, Wiese, Goldberg and Shaw.  Noes:  None.  Absent:  None.  Motion carried unanimously.

 

APPROVAL OF ACCOUNTS PAYABLE.

 

                    Motion was made by Ald. Wiese, seconded by Ald. Goldberg, to approve the accounts payable register dated April 14, 2008 for check numbers 21223 to 21320 totaling $272,882.46 and for prepaid checks, numbers 21029 to 21036 and 21138 to 21197 totaling $17,880,761.50.  On Roll Call:  Ayes:  Ald. Whitaker, Colacino, Moeser, Wiese, Goldberg and Shaw.  Noes:  None.  Absent:  None.  Motion carried unanimously.

 

COMMISSION, COMMITTEE AND BOARD REPORTS.

 

                    Several Council members briefly reported on the activities of the various Commissions, Committees and Boards they serve on.  Mayor Tepper congratulated Ald. Colacino, Shaw and Wiese on their recent election victories.

                    There being no further business, motion was made by Ald. Shaw, seconded by Ald. Whitaker, to adjourn the meeting.  Ayes:  Ald.
